Fair Use guidelines are the basis for library reserve policy. Faculty members may request that the library place on reserve copies of articles
or chapters of books.

The following guidelines apply to both electronic and paper reserves:

  1. Works as published and owned by the library or faculty member (e.g., books or issues of periodicals) do not require copyright permission.
  2. The faculty member or the library must already possess legally obtained copies (i.e., by purchase, license, fair use, interlibrary loan, etc.) of copied materials.
  3. Durable links to articles from databases with appropriate licensing agreements may also be placed on reserve.
  4. Fair use guidelines must be observed:
    • The purpose and character of your use: The copy should be a direct photocopy or scanned copy of the original, not changed in any way without permission.
    • The nature of the copyrighted work: Copies of published and non-fiction materials have fewer restrictions on them than unpublished or fiction works. Please obtain permission for all unpublished works, even material produced by your students.
    • The amount and substantiality of the portion taken: The amount of information copied should be reasonable in relation to the size of the entire work (e.g. An article or a chapter from a book).
    • The effect of the use upon the potential market: Educational use is limited in order to protect the commercial interests of the copyright holder. Need for repeated use of the same material or of multiple chapters in a book means that the material should be purchased
      rather than copied.
  5. Copied material may be placed on reserve for a given course for only one quarter without copyright permission. For use in subsequent quarters, instructors must obtain permission from copyright holders or provide documentation that permission has been requested. (See the section on getting permission.)
  6. At the end of each quarter, the library will remove materials that lack permission from the copyright holder. Print materials will be returned to faculty; and access to electronic files will be removed at the end of the quarter. Materials may be kept on reserve for an additional quarter if the instructor provides documentation that permission has been requested.
  7. Copyright protected reserve material must include a citation and a copyright notice, either on the first page of the portion of material duplicated, or on an intermediary screen for electronic reserve material: NOTICE: This material may be protected by copyright law (Title 17 U.S. Code).
  8. The Library will provide access to copied reserve material by instructor and/or class name. Online reserve material will be password protected. Passwords will be changed quarterly.
  9. Course packs without indication of permission for individual works copied will not be placed on reserve.
  10. Duplicates of entire works will not be placed on reserve.
